They are Filipino residents. Filipinos who live abroad and Filipino workers. Your Balikbayan Boxes should be processed and released as quickly as possible. WHO HAS THE AUTHORITY TO SEND BALIKBAYAN BOXES TO THE PHILIPPINES? Anyone, including corporations, partnerships, and sole proprietors, may send balikbayan boxes to the Philippines. Only a Qualified Filipino While Abroad is eligible to use the balikbayan tax and duty-free privilege.
What does the CMTA Section 800G Privilege entail? 6. Member or Relative. Duty-free and tax-free. CAN I SEND RALIKBAYAN BOXES MORE THAN ONCE? Unless you choose to use the Balikbayan Box Privilege, there is no restriction. HOW OFTEN MAY I EXERCISE MY BALIKBAYAN BOX PRIVILEGE? The combined value of all shipments should not exceed P150,000.00. throughout a year. not be taken into account. IF I USE THE BALIKBAYAN BOX PRIVILEGE, HOW MANY BALIKBAYAN BOXES CAN I SEND IN ONE SHIPMENT? The calendar year has no boundaries. Workers. Your Balikbayan Boxes should be processed and released as quickly as possible. WHO HAS THE AUTHORITY TO SEND BALIKBAYAN BOXES TO THE PHILIPPINES? Sending Balikbayan Boxes to the Philippines is open to all.

You cannot send items in commercial quantities, prohibited or restricted items, or items that are for sale, barter, or hire. A good rule of thumb is not more than 20 items of each kind for consumable goods and not more than 5 items of each kind for non-consumable goods. Excise tax must be paid on imports of up to 2 liters (2008 ml) of wine or liquor, 2 reams of cigarettes, and 50 sticks of cigars. Duty, VAT, and excise tax are all applicable to any excess.
WHAT HAPPENS IF I DECLARE THAT I WANT TO USE THE BALIKBAAN BOX AND I PURCHASE MORE THAN WHAT IS PERMITTED? Such excess is subject to seizure and/or all applicable taxes. WHAT SHOULD I DO IF MY SHIPMENT'S VALUE IS UNDER PHP100000.S? For the immediate release of shipments sent by or to be received by a Corporation, Partnership, or Sole Proprietorship, you may use the De Minimis privilege. Even if you are a Qualified Filipino While Abroad, you are not eligible for the Box privilege unless you ship something of Minimal Value.

For the purpose of duty and tax exemption, the balikbayan box should only contain personal and household items that are sent by qualified Filipinos while abroad and are typically shipped by Freight Forwarders who specialize in balikbayan boxes by sea or air. These items should not be sent in commercial quantities, for sale, or for hire.
2. Qualified Filipinos While Abroad - A collective term for Residents, OFWs, and Non-Resident Filipinos who are eligible to send or bring in balikbayan boxes and are exempt from duty and tax under Section 800g of the CMTA.
3. "Resident Filipinos" refers to Filipino nationals who are temporarily residing outside of their country. These individuals may be in possession of visas that allow them to travel, invest, or study abroad.
4. Nan-Resident Filipinos - These are Filipinos who have made a permanent move abroad but have kept their citizenship, regardless of whether they have benefited from Republic Act No. 9225 or the Citizenship Retention and Re-Acquisition Act of 2003.
5. An overseas Filipino worker (OFW) is someone who has a Philippine Overseas Employment Administration (POEA) or Department of Labor and Employment (DOLE)-issued passport that is currently valid and has been certified for overseas employment. Regardless of their occupations, skills, or employment status abroad, this applies to all Filipinos with employment contracts who work abroad. This also applies to Filipinos who work abroad on temporary contracts and do not need a DOLE or POEA certification.
6. Family and Relatives - refer to family members who are first cousins or consanguineous up to the fourth civil degree of affinity. 7. The term "calendar year" refers to the time frame encompassing January 1 and December 31 of the same year. 8. Household effects refers to furniture, cookware, linens, bookshelves, and other similar home furnishings for private use. 9. Personal Effects - include items like clothing, jewelry, electronics, toiletries, and other similar items that are purchased for personal use or consumption and not for sale.
10. Commercial quantity is the amount of a particular kind or class of goods that is greater than what is compatible with and commensurate to the buyer's regular needs for personal use.* The commercial quantity of a given item for a single Sender with multiple ultimate consignees shall be determined based on the total quantity thereof sent by the Sender to all the consignees.
11. Prohibited imports - The importation of the following items is forbidden: a) written or printed goods in any form that advocate or incite treason, rebellion, insurrection, or forcible resistance to any Philippine law; or written or printed goods that threaten to kill or harm anyone in the Philippines;
{b} Any printed material that promotes, describes, or provides direct or indirect information about where, how, or by whom unlawful abortion is committed; b) goods, instruments, drugs, and substances designed, intended, or adapted for producing unlawful abortion;
(c) Any written, printed, photographic, engraving, lithographic, object, painting, drawing, or other depiction of an obscene or immoral character:
{-d} Any products that are entirely or partially made of gold, silver, or other precious metals or alloys but whose stamp, brand, or mark does not accurately reflect their actual fineness or quality;
e) Any drug that is adulterated or misbranded and in violation of the applicable laws and regulations, as well as any adulterated or misbranded goods intended for human consumption;
f) Products that violate the Intellectual Property Code andother laws; and
g) All other goods or components thereof, the importation of which is expressly forbidden by law or by rules and regulations made by the appropriate authority.
12. Restricted Importation - The following restricted goods may not be imported, unless specifically permitted by law or regulation:
The explosive. weapons of war, including firearms and ammunition, as well as other explosives;
(b) Pinball machines, jackpot machines, and similar devices; Roulette wheels, gambling outfits, loaded dice, marked cards machines, apparatus or mechanical devices used in gambling or the distribution of money, cigars, cigarettes, or other goods when such distribution is dependent on chance;
c) Tickets for lotteries and sweepstakes, excluding their advertisements and lists of drawings;
{d} marijuana, opium, poppies, cola leaves, heroin, or any other narcotics or synthetic drugs that the President of the Philippines has declared to be habit-forming, as well as any compound, manufactured salt, derivative, or preparation thereof, unless they are imported for medical use by the Philippine government or a person who has been properly authorized by the Dangerous Drugs Board;
e) Opium pipes or components made of any material;
f) Any additional products whose importation is prohibited;
g) Items on the National Strategic Goods List (NSGL), as established by Republic Act No. 1as97 or the Strategic Trade Management Act (STMA), and weapons of mass destruction;
(h) Toxic and hazardous goods covered by Republic Act No. 6969, also known as the "Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990." The prohibition against importing the aforementioned goods also applies to their transit.
13. De Minimis Value is defined as an FCA or FOB value of Php 10,000 or less for which no duty or tax is collected.
14.
